The Terms of Sale apply to the purchase of artworks from us through www.curatedby.art. Please carefully review the Terms of Sale and ensure that you comprehend them prior to acquiring any artwork from the website. By placing an order on our website, you acknowledge your agreement to the Terms of Sale.
While we strive to provide stock indications on our site, we cannot guarantee the availability of artworks at all times, and these indications may not always be accurate. We cannot provide an assurance that the artworks will always be available for purchase. While we endeavor to offer stock indicators on our website, such indicators may not invariably be precise.
We retain the right to modify prices and to include, modify, or eliminate special offers as necessary and at any time.
The price of transportation and framing may not always be incorporated in the price of artworks on our website. During the ordering procedure, the available delivery and framing options, as well as the relevant fees, will be presented.
Please note that customs duties may apply to international orders according to regulations of the destination country, and these fees are the responsibility of the customer. Such customs fees, which are separate from shipping and handling costs, must be paid by the customer upon delivery and cannot be discounted or reimbursed by us.
Before submitting your order, please carefully review and amend it using the guided ordering process on our site.
In case you provide us with incomplete or inaccurate information during the order process, please inform us immediately. We will contact you to correct the information and if we are unable to process your order due to the incorrect information, we may cancel your order. If any costs are incurred due to the incorrect information, we may charge you for those costs. Your contact details may be shared with the artist unless you opt-out by emailing us at info@curatedby.artat the time of purchase.
The China Connector Holding B.V., which is responsible for the curation and selection of the artworks on www.curatedby.art, has the authority to refuse or revoke orders for any reason. If your order cannot be accepted or fulfilled, you will be informed through the email address you provided during the ordering process. If payment has already been made, it will be refunded within 30 days.
You are required to pay for both the artworks and delivery fees in advance, with payment instructions provided during the ordering process. Any refunds owed to you will be issued using the same payment method used for the initial purchase. If goods are returned, refunds will be processed within 7 days upon the receipt of artworks in original condition in original box.
The artworks that are purchased from our website will usually be dispatched from our warehouse within 2 weeks of purchase, but this may be delayed, particularly for pre-ordered or framed items. We will keep you informed of any delays during this period.
We use selected global carriers for all standard shipments.
If we are unable to deliver the artworks to your preferred address, we will leave a note informing you of the situation and provide instructions for re-delivery. Failure to collect the artworks or arrange for re-delivery may result in additional charges for storage and delivery. If we cannot contact you or arrange for re-delivery or collection, we may cancel the order and issue a refund, less any expenses incurred by us.
The delivery is considered complete and the responsibility of the artworks passes to you once we have delivered them to your provided address.
Once you have paid in full, including any relevant delivery fees, the ownership of the artwork will be transferred to you.
In case the artworks you have purchased have defects or damages, or you have received incorrect or wrongly priced items, please contact us at info@curatedby.art as soon as possible to notify us of the problem with pictures attached, and to arrange for a refund, repair, or replacement.
You have the right to reject the artworks and receive a full refund within 30 calendar days from the date of delivery if they do not comply as mentioned above.
Please be aware that you cannot claim under this clause if we had already informed you about the faults, damages, or other problems with the goods before you made the purchase.
Requests to cancel or modify an order must be submitted within 24 hours of placing the order. We cannot accept any requests made after this period as the artworks would have been sent to our framing partner or already prepared for shipment.
To return your purchase, please ensure it is in perfect condition and in its original packaging within 7 business days of receiving it. We cannot provide refunds for framing or delivery costs, and the return shipment to our office in the Netherlands must be paid for by you.
We will accept responsibility for any foreseeable harm or loss resulting from our violation of the Terms of Sale or negligence, but not for unforeseeable harm or loss.
However, we will not be held responsible for any failure or delay in meeting our obligations that results from causes beyond our control. In such cases, we will promptly notify you and do our best to minimize any delays.
Our obligations and rights under these Terms of Sale can be transferred (assigned) to a third party, such as if we sell our business. If this happens, we will notify you in writing, but your rights under these Terms of Sale will not be impacted.
